AXJ NEWS BOSTON INTERVIEWS A WITNESS PRESENT AT THE ARRAIGNMENT OF DZHOKHAR ( JAHAR ) TSARNAEV

At approximately 15:30 hours ( 03:30 pm ) EST today Dzhokhar ( Jahar ) Tsarnaev appeared before U.S. Magistrate Judge Marianne Bowler in the Moakley Federal Courthouse in Boston. He was arraigned for 30 charges, including four for murder, as a result of using and conspiring to use a weapon of mass destruction. Jahar plead NOT GUILTY to all the charges against him.

According to an eye witness present in the Court Room interviewed by AXJ NEWS, the defense did not raise any issues questioning venue nor competent jurisdiction of the Court, nor petitioned the Court for a Writ of Habeas Corpus based on an unlawful arrest and the violation of constitutional rights. What I saw yesterday in the courtroom. If was awful, the victims who came looked devastated. When his sisters came in they looked... devastated. The atmosphere was intense. When he came in he looked strong. He looked like he was swaggering. But maybe it was the shackles, I was focusing on his face. When he saw his sisters he smiled. And he looked back at them and smiled. Over and over. When the baby cried he looked over quickly. He almost couldn't take his eyes off them. He did seem to have an arrogant stance. He sort of leaned back in his chair with his arm over. But probably to be able look at his sisters better. He was fidgety and stroked his chin, held his chin in his hands. I saw his hands shaking. He was nervous. He did not look at the victims or anyone else just his family. The judge did not allow his attorneys to speak for him but made him stand and address each group pf charges himself. His accent was thick, but probably from nerves. Like when I get all anxious and start saying things like "Pahk the cah. I don't cayah." Your natural accent always comes out when you're nervous. The judge asked how long and how many witnesses might be called. Instructed the defence to put together a budget sooner rather than later. Said she doesn't like to seal proceedings. The people have a right to know. While most of the proceedings thus far have been sealed she won't plan on doing so going forward without a compelling reason. His lawyer put her hand on his shoulder. I did not see her rub his back. She mouthed to his family several times are you ok. The whisked them out quickly and had a row of people sit behind them shoulder to shoulder. The baby was a little girl who was adorable. They were dressed in what I think as full Muslim garb, but beautiful. Not the black. He had some bells palsy looking on this left side and his left arm was in a brace/cast. But he looked as handsome as in amy of his pictures. It's a little startling really. Overall it was just awful a waste of lives all the way around for nothing.

FLAWED ADMINISTRATION OF JUSTICE

Many legal critics are analyzing the arrest of Dzhokhar ( Jahar ) Tsarnaev by the FBI and Police Authority, and the state of "voluntary detention" under custody of the U.S. Marshall, and can not understand how the Defendent has not been allowed the possibility of questioning venue, competent jurisdiction, and opposing his arrest as unlawful. Justice has failed Mr. Tsarnaev in obligating him to accept the competent Jurisdiction of the Court ignoring the fact that his arrest was unlawful, and obligating him to declare himself NOT GUILTY of the 30 charges against him. Of course he is not guilty unless it is proven otherwise by a Jury of his Peers in a Public Hearing and Courtroom.

Yet he has not be able to confront witnesses nor question the evidence presented as "probable cause" to arrest and hold him without bail, until the day of his hearing still not on calender. His case will probably be scheduled 2 years from now so Mr. Tsarnaev will have plenty of time to study Law. As a matter of fact, today he has experienced the fact that he can stand before a Federal Judge and state publicly that he is not guilty of the charges levied against him. It will also be up to him to oppose the evidence and explain to the world that he truly is not guilty of the crimes he is charged with.

A good start for Mr. Tsarnaev is that female DNA was discovered on fragments of the pressure cooker bomb he allegedly manufactured, trasported to, set in place, and detonated at the Boston Marathon on April 15, 2013 at 14:50 hours (02:50 pm ) EST. We have obviously not seen all the evidence against him but the following photos have appeared on the internet supposedly taken in front of the Forum Restaurant at 755 Bolyston Street where the pressure cooker bomb was allegedly placed by Mr. Tsarnaev.
