Apparently on an initial appearance on April 22, 2013 Dzhokhar Tsarnaev was not permitted to challenge the venue, competent jurisdiction, nor present an Habeas Corpus before he was instructed to agree to a "voluntary detention" by the United States Marshals Service. In this country your are innocent until proven guilty by a Jury of your peers. By filing an Habeas Corpus Mr. Tsarnaev would obligate the Boston Police to present their evidence in a hearing. If the Judge has simply a doubt about the evidence he walks free. Of course the public defender kept quite the whole time.
